On August 15, 2023, amendments to the European Union’s Cosmetic Regulation (EC) No. 1223/2009 will take effect. Among these amendments is an update to fragrance allergens listed in Annex III, which adds 56 new substances.
Although these amendments are specific to an EU regulation, products sold into the state of California may be impacted. California’s Cleaning Product Right to Know Act (CPRTKA) requires disclosure of specific information on websites and labels for designated products. Specific to fragrance allergens, the CPRTKA requires disclosure of fragrance allergens included on Annex III of the EU Cosmetics Regulation No. 1223/2009 (as required to be labeled by the EU Detergents Regulation No. 648/2004) as follows:
Website disclosure:
- Disclose each fragrance allergen present in the designated product at a concentration equal to or greater than 0.01% (100ppm).
Label disclosure:
- Option 1: disclose each fragrance allergen present in the designated product at a concentration equal to or greater than 0.01% (100 ppm).
- Option 2: a statement that reads “Contains fragrance allergen(s)” when a fragrance allergen is present in the designated product at a concentration equal to or greater than 0.01% (100 ppm).
When a change to a designated list or Annex III would result in a revised disclosure of a designated product, the CPRTKA requires manufacturers to revise the website and label disclosures as outlined below:
- Website disclosure: revisions to the disclosure must be made no later than six months¥ after the adoption of the revised list by its respective authoritative body.
- Label disclosure: revisions to the label disclosure must be made no later than 18 months¥ after the adoption of the revised list by its respective authoritative body.
Because designated lists and Annex III are not static, it is strongly recommended to conduct a review at least every 6 months to ensure product disclosures are up to date. *As set forth in Ch. 13 Part 3 of Div. 104 of the California Health and Safety Code, a “Designated product” means a finished product that is an air care product, automotive product, general cleaning product, or a polish or floor maintenance product used primarily for janitorial, domestic, or institutional cleaning purposes. “Designated product” shall not mean any of the following:
(1) Foods, drugs, and cosmetics, including personal care items such as toothpaste, shampoo, and hand soap.
(2) Industrial products specifically manufactured for, and exclusively used in the following:
Oil and gas production, Steel production, Heavy industry manufacturing, Industrial water treatment, Industrial textile maintenance and processing other than industrial laundering, Food and beverage processing and packaging, Other industrial manufacturing processes.
(3) A trial sample of a designated product that is not packaged for individual sale, resale, or retail and includes a statement indicating that the product is not for sale or resale.
“Air care product” means a chemically formulated consumer product labeled to indicate that the purpose of the product is to enhance or condition the indoor environment by eliminating unpleasant odors or freshening the air.
“Automotive product” means a chemically formulated consumer product labeled to indicate that the purpose of the product is to maintain the appearance of a motor vehicle, as defined in Section 670 of the Vehicle Code, including products for washing, waxing, polishing, cleaning, or treating the exterior or interior surfaces of motor vehicles. “Automotive product” does not include automotive paint or paint repair products.
“General cleaning product” means a soap, detergent, or other chemically formulated consumer product labeled to indicate that the purpose of the product is to clean, disinfect, or otherwise care for fabric, dishes, or other wares; surfaces including, but not limited to, floors, furniture, countertops, showers, and baths; or other hard surfaces, such as stovetops, microwaves, and other appliances.
¥Unless a later date of effect is established by the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) or Annex III of the EU Cosmetics Regulation No. 1223/2009 (as required to be labeled by the EU Detergents Regulation No. 648/2004.
